Action in the Stearns County District Court for personal injuries allegedly sustained by plaintiff Collene Kloos and for consequential
damages incurred by her husband, plaintiff Lawrence Kloos, arising out of a collision wherein an automobile operated by Collene
Kloos collided with a truck owned by defendant National Car Rental, Inc., and operated by defendant Arthur H. Quitt as an
employee of defendant Soo Line Railroad. The case was tried before Norman H. Nelson, Judge, and a jury, which returned verdicts
for plaintiffs for $5,000 and $3,182 respectively. Thereafter, plaintiffs moved for a new trial. The court denied the motion
as to Collene Kloos but granted her husband's motion unless defendants consented to an increase in his verdict to $4,135,
